Anyone seen this before? what Im doing wrong? :D

I can't see no issue with your config. But try and update the checkout action version.
Replace

 - uses: actions/checkout@v1
        with:
          submodules: recursive

by

 - uses: actions/checkout@v3

Also remove container: ubuntu and what's your magento version ?

@seyuf Oh thanks a lot. I had the previous version I guess but I still have related issue maybe server is down

Just checked the issue is with github. There seems to be 503 on all there docker services
